01 · Manufacturing in Chicago

Finger-scan time clocks come with paperwork in Illinois.

Under BIPA, a plant or warehouse that clocks people in with a finger scan needs a written release from each person before the first scan, a public retention policy, and proof the data was destroyed on time. The releases and the destruction records are documents, and they have to be found when someone asks.

02 · Logistics and freight in Chicago

Rules

FMCSA driver qualification files
Motor carriers keep each driver’s qualification file for as long as the driver is employed and three years after (49 CFR 391.51). Hours-of-service supporting documents are kept six months (49 CFR 395.8). A retention schedule per document type clears each on its own clock.
Customs records
Importers keep entry records for five years from the date of entry (19 CFR Part 163). Commercial invoices and packing lists can be filed by entry and kept for that period.

03 · Banking and lending in Chicago

A complete loan file before it goes to underwriting.

A loan file goes to underwriting without the borrower’s second pay statement. It comes back with a condition, the processor chases the borrower again, and the closing date slips.

Biometric Information Privacy Act (BIPA)

740 ILCS 14

Applies to
Private entities that collect fingerprints, face geometry, hand scans, retina or iris scans, or voiceprints, including finger-scan time clocks.
What it asks
A written, public retention and destruction policy; destruction when the purpose is met or within three years of the person’s last interaction, whichever comes first; and a written release from each person before collection. A 2024 amendment confirmed an electronic signature can serve as that release.
What the software does
Signed releases captured and filed by employee, a retention schedule that counts from the end of employment, and an audit trail showing when each record was destroyed.

Personal Information Protection Act

815 ILCS 530

Applies to
Businesses that hold personal information about Illinois residents.
What it asks
Reasonable security, notice to affected residents after a breach (and the Attorney General when more than 500 are affected), and disposal of records so personal information cannot be read or reconstructed.
What the software does
Permissions, multi-factor sign-in, an audit trail, and retention schedules with a destruction schedule.

Illinois Human Rights Act: AI in employment

775 ILCS 5/2-102, as amended by HB 3773 (in effect since January 1, 2026)

Applies to
Employers in Illinois that use AI in decisions about hiring, promotion, discipline, discharge and similar terms of employment.
What it asks
Notice to employees when AI is used for those decisions, and no use of AI that has the effect of discriminating, including using zip codes as a stand-in for a protected class.
What the software does
The document AI we deploy works on paperwork, reading it, routing it and moving its data; it does not decide who is hired. If a project would touch employment decisions, we say so in the assessment.

What Chicago teams ask us.

We use finger-scan time clocks. What does BIPA mean for our records?

BIPA asks for a written release from each person before the first scan, a public retention and destruction policy, and destruction within three years of the person’s last interaction at the latest. Those releases and destruction records are documents. We file the releases by employee and set retention that counts from the end of employment.

Illinois now regulates AI in hiring. Does your AI fall under it?

The document AI we deploy works on paperwork such as invoices, bills of lading and loan documents: reading it, routing it and moving its data where it belongs. It does not decide who is hired or promoted. If a project you propose would feed an employment decision, the assessment says so, and that part goes to your counsel first.

Can CapturePoint 6 put a packing slip with its purchase order?

Yes. CapturePoint 6 reads the PO number from purchase orders and invoices, and the order number from packing slips. When the slip carries your PO number, both are named and filed under it.
