01 · Banking and lending in New York

GLBA Safeguards Rule
Non-bank lenders and brokers follow the FTC version (16 CFR Part 314): a written information security program, multi-factor sign-in, and disposal of customer information no later than two years after it was last used unless you have a reason to keep it. Banks follow the interagency guidelines. Content Central supports MFA, permissions and retention schedules that clear documents on time.
Regulation Z (TRID) record keeping
Lenders keep evidence of compliance for the Loan Estimate for three years after closing and the Closing Disclosure for five. Each can be its own document type with its own retention period.

If DFS licenses you

Part 500 turns security into paperwork you have to keep.

Banks, insurers and other companies licensed by the New York Department of Financial Services file with the department every year by April 15, and the regulation asks for disposal policies for nonpublic information you no longer need. The evidence behind that filing is documents: policies, access reviews, risk assessments and records of what was disposed of and when.

It can. The SHIELD Act reaches any business that owns or licenses computerized private information of a New York resident, wherever the business is. We do not give legal advice, but the assessment lists which of your document streams hold that information and where they are stored today.
