18 CFR Part 125 for public utilities and Part 225 for natural gas companies set how long each kind of record is kept. Many state commissions adopt or add to them.

Texas Data Privacy and Security Act

Texas Business and Commerce Code, Chapter 541 (in effect since July 1, 2024)

Applies to
Businesses that do business in Texas or serve Texans and process personal data, unless they are small businesses as the U.S. Small Business Administration defines them. There is no revenue threshold.
What it asks
People can ask to see, correct, delete or get a copy of their personal data, and you answer within 45 days. Sensitive data needs consent, and some processing needs a data protection assessment.
What the software does
Full-text search finds every document that names a person, and permissions and retention schedules control who sees it and when it is deleted.

Identity Theft Enforcement and Protection Act

Texas Business and Commerce Code, Chapter 521

Applies to
Any business that collects or keeps sensitive personal information about Texans.
What it asks
Reasonable procedures to protect sensitive personal information, destruction of customer records you will not keep, and notice to affected people after a breach, plus the Attorney General when 250 or more Texans are affected.
What the software does
Permissions by document type and field, multi-factor sign-in, an audit trail, and retention schedules with a destruction schedule.

Texas Medical Records Privacy Act

Texas Health and Safety Code, Chapter 181

Applies to
A wider group than HIPAA: anyone who assembles, collects, analyzes, uses, stores or transmits protected health information, including many businesses HIPAA does not cover.
What it asks
Staff training on handling health information, and when a provider uses electronic health records, a patient’s written request for their electronic record answered within 15 business days.
What the software does
Patient documents filed by patient and account number come up in one search, so a records request is gathered in minutes rather than days.

03 · Logistics and freight in Houston

Texas medical privacy law is broader than HIPAA. What changes for us?

The Texas Medical Records Privacy Act covers anyone who handles protected health information, not only HIPAA covered entities, and asks for staff training. Where a provider uses electronic health records, a patient’s written request for their record is answered within 15 business days. Records filed by patient and account number make that a search, not a hunt.
